PRIVACY POLICY

Pausemark ("we", "us", "our") respects your privacy. This policy explains what personal data we collect, how we use it, and your rights under the EU General Data Protection Regulation (GDPR) and applicable laws.
WHO WE ARE
Pausemark is an independent brand operated by Julien Denis from France. We are the data controller for personal data collected through pausemark.shop.

WHAT DATA WE COLLECT
When you visit, contact, or order from us, we may collect:
- Identification: first and last name, email address, postal address, phone number (when provided for orders or support).
- Order data: products purchased, prices, payment confirmation (we never see your full card number — see "Payment" below).
- Communication data: emails you send us, customer support exchanges.
- Browsing data: pages visited, time spent, device and browser type, IP address, referral source. Collected via cookies and similar technologies (see § Cookies).
We do not knowingly collect data from children under 16. If you believe a minor has submitted data to us, contact us and we will delete it.
WHY WE USE IT (LEGAL BASIS)
- To process and fulfill your orders — legal basis: performance of a contract (GDPR Art. 6(1)(b)).
- To send order confirmations, shipping updates, and respond to support requests — legal basis: performance of a contract.
- To send marketing emails (newsletter, product updates) — legal basis: your consent (GDPR Art. 6(1)(a)). You can withdraw consent at any time via the "unsubscribe" link in any marketing email.
- To improve our website, measure performance, and serve relevant advertising — legal basis: your consent (cookies non-essential) or legitimate interest (essential analytics).
- To comply with legal obligations (accounting, tax, fraud prevention) — legal basis: legal obligation (GDPR Art. 6(1)(c)).
SUB-PROCESSORS
We rely on the following service providers, each of whom processes personal data on our behalf under contractual GDPR safeguards:
- Shopify Inc. (Canada) — store hosting, checkout, order management.
- Shopify Payments / Stripe — payment processing (we never store full card data; processed and stored by the payment provider directly).
- Klaviyo Inc. (USA) — email marketing and transactional emails.
- Meta Platforms Ireland Ltd. — Facebook/Instagram pixel analytics and advertising (only with your cookie consent).
- DSers / AliExpress fulfillment partners (China) — order fulfillment (your name and shipping address are shared with the fulfillment partner solely to ship your order).
- Namecheap Inc. — domain registration and DNS.
International transfers outside the EEA (e.g., to Shopify in Canada or Klaviyo in the USA) are governed by Standard Contractual Clauses or adequacy decisions, in line with GDPR Articles 44 to 49.
HOW LONG WE KEEP YOUR DATA
- Order data: 10 years after the last transaction (legal accounting obligation under French law).
- Customer account: as long as your account is active, plus 3 years of inactivity (commercial prospection limit, CNIL guidance).
- Newsletter consent: until you unsubscribe, plus 3 years from the last interaction.
- Support email exchanges: 3 years.

YOUR RIGHTS
Under GDPR you have the right to:
- Access the personal data we hold about you.
- Rectify inaccurate or incomplete data.
- Request erasure ("right to be forgotten") subject to legal retention.
- Restrict or object to certain processing.
- Data portability (receive your data in a structured, common format).
- Withdraw consent at any time, where consent is the legal basis.
- Lodge a complaint with the CNIL (the French data protection authority) at https://www.cnil.fr/fr/plaintes if you believe we have not respected your rights.

COOKIES
Our store uses cookies and similar technologies. Essential cookies (cart, login, security) are always active. Analytics and advertising cookies are only set after your explicit consent via the cookie banner displayed on your first visit. You can

CHANGES TO THIS POLICY
We may update this Privacy Policy. The current version is always available at pausemark.shop/policies/privacy-policy. Material changes will be notified by email when we have your address.
